Monopoly.finance is brought to you by Team Arkhe. (“Arkhe”) and its affiliates (collectively, “we,” “us,” or “our”) committed to creating open-source software that empowers users' financial, social and cultural independence. Monopoly.finance provides information and resources about the fundamentals of the decentralized non-custodial liquidity protocol called the Monopoly Protocol (the “Monopoly Protocol” or “Protocol”). Monopoly.finance is not one of the available access points to the Monopoly Protocol.

ARBITRATION NOTICE: THESE TERMS (“TERMS”) CONTAIN AN ARBITRATION CLAUSE BELOW. EXCEPT FOR CERTAIN TYPES OF DISPUTES MENTIONED IN THAT ARBITRATION CLAUSE, YOU AND WE AGREE THAT ANY DISPUTES RELATING TO THE SERVICES (AS DEFINED BELOW) WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION, AND YOU WAIVE ANY RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.You are entering into a binding Agreement.

BY ACCESSING OR USING OUR SERVICES, WHICH INCLUDE OUR VARIOUS WEBSITES, INCLUDING, WITHOUT LIMITATION, MONOPOLY.FINANCE (AND ANY RESPECTIVE SUBDOMAINS); APPLICATIONS (COLLECTIVELY WITH ANY MATERIALS AND SERVICES AVAILABLE THEREIN, AND SUCCESSOR WEBSITE(S) OR APPLICATION(S) THERETO, THE “SITE”), AND OTHER SERVICES THAT LINK TO THESE TERMS, AS WELL AS ANY INFORMATION, TEXT, LINKS, GRAPHICS, PHOTOS, AUDIO, VIDEO, OR OTHER MATERIALS STORED, RETRIEVED OR APPEARING THEREON, WHETHER ACCESSED THROUGH THE SITE OR OTHERWISE (COLLECTIVELY, THE “SERVICES”), YOU ARE ENTERING INTO A BINDING AGREEMENT WITH US THAT INCLUDES THESE TERMS, MONOPOLY.FINANCE - PRIVACY POLICY (FOUND HERE), AND OTHER POLICIES REFERENCED HEREIN (COLLECTIVELY, THE “AGREEMENT”).

To the extent that there is a conflict between these Terms and any applicable additional terms, these Terms will control unless expressly stated otherwise. If you don't agree with these Terms, you may not use the Services and should not visit the Site or otherwise engage with the Services.

Use of the Services

To use the Services, you must legally be able to enter into the Agreement. By using the Services, you represent and warrant that you meet the eligibility requirement. If you do not meet the requirement, you must not access or use the Site or the Services.

We may update the Services and the Terms.

We may update the Services, the Agreement, and any part of the Terms at any time, for any reason, at our sole discretion. Once any part of the Agreement is updated and in effect, you will be bound by the Terms if you continue to use the Services, including by accessing the Site. We may, at any time, and without liability to you, modify or discontinue all or part of the Services (including access to the Services via any third-party links). You may contact us with questions about your use of the Services at monopoly@monopoly.finance. When you communicate with us electronically, you consent to receive communications from us electronically. You should review the Terms from time to time to ensure that you understand the terms and conditions that apply to you when you access or use the Site.

2. Services

Monopoly.finance is an informational resource that provides information about the Monopoly Protocol and its ecosystem, governance, community, and interfaces. The information provided is only for informational purposes and should not be used as the sole basis for financial, legal, technical, or other decisions. The Monopoly Protocol is a decentralized, community-governed protocol deployed on multiple blockchain networks and is not controlled or maintained by Monopoly.finance. Users retain control of their cryptoassets at all times and are responsible for securing their private keys. Monopoly.finance is not a party to any transactions on the blockchain, an intermediary, agent, advisor, or custodian, and does not have access to users' private keys or information beyond what is publicly available on the blockchain. The Monopoly Protocol is subject to sudden changes in operating rules, such as forks, and transactions on the blockchain are transparent, not anonymous. Blockchain transactions require the payment of gas fees, which are non-refundable. Monopoly.finance does not provide services or receive fees for any transactions. Community contributors to the Monopoly ecosystem are independent of Monopoly.finance and Monopoly.finance does not assume any liability for their actions.

3. Assumption of Risk

By using Monopoly Protocol, you acknowledge that you're taking on the risk of transactions relying on smart contracts and experimental technology. The blockchain technology used is experimental and speculative, so there's a risk of bugs, cyberattacks, or changes to the blockchain (e.g. forks) causing disruptions and even loss of cryptoassets, market value, or digital funds. You are solely responsible for the security of your private key, and we do not assume any liability. Immutable entries on the blockchain, including transfers and data programmed into cryptoassets, are permanent and can't be deleted or modified by anyone, so you must be careful with transactions recorded on the blockchain. We're not responsible for any third-party services or links, or for the security of your wallet. We reserve the right to restrict access to the Services if we suspect illegal or inappropriate activity. The use of the Services and all transactions processed through smart contracts are irreversible, final, and without refunds. We don't guarantee the quality, security, or availability of the Services.

8. Indemnification

You promise to protect and defend the Arkhe Indemnified Parties from any claims or demands made by third parties that result from your violation of the agreement, misuse of services, violation of laws, or infringement of third-party rights. You agree to cover the costs of defense and to not settle any claims without prior written consent.

9. Arbitration Agreement and Waiver of Rights, Including Class Actions.

Before filing any legal action, you and the company agree to try to resolve any disputes through good faith negotiations. If the dispute cannot be resolved, it will be resolved through binding arbitration in the Cayman Islands, using English as the language of arbitration, and the arbitrator must have experience with internet technology, financial transactions, and ideally blockchain technology. The arbitrator's decision must be consistent with the Limitation of Liability section of the Terms. The prevailing party will be entitled to reasonable attorney fees and costs. The arbitration process and its results must not be disclosed without the prior written consent of both parties, unless required by law. By accepting these Terms, you are giving up your right to a trial by jury and to participate in any class action. This arbitration agreement applies to any changes to these Terms.

10. Waiver of Injunctive or Other Equitable Relief.

You agree that you won't seek or be allowed to get any court actions or injunctions that could interfere with the services or related products or intellectual property, to the extent allowed by law.

11. Termination; Cancellation

The agreement between you and the company will remain in effect until either you or the company ends it. You can end the agreement at any time by stopping access to the services. The company may also end the agreement if you fail to comply with its terms, or if they suspect you are misusing the services. The company has the right to modify the services, remove them, or cancel them at any time without notice.

12. Unenforceable Provisions

If any provision of the agreement is found to be illegal or unenforceable, it will still be enforced to the maximum extent allowed by law, and the unenforceable part will be separated from the agreement.

13. Assignment

The company may assign the agreement to any party associated with the services, without your consent. You can't assign the agreement without the company's written consent.

14. Entire Agreement

The agreement, including these terms, and the company's privacy policy, is the complete understanding between you and the company, and supersedes any previous agreements. The company's failure to enforce any part of the agreement does not waive its rights.

15. Governing Law

The terms of the agreement and any separate services agreements will be governed by the laws of Republic of Korea.

16. Safety and Security

Monopoly Protocol has received professional security audits from credible professionals in the industry, and is in its continuous effort to improve security and to minimize vulnerabilities.
